1 day ago, Christina Athey
CITY MANAGER AUTHORIZATION FOR SPECIAL EVENT Pursuant to Ordinance 8.02.002 Sale or Use of Fireworks (1995 Code, sec. 13-2), the City Council of the City of Fritch enacted an exception on June 20, 2017, and further authorized the City Manager to define the exception to this ordinance on June 25, 2018, authorizing the City Manager to grant permission for special events involving fireworks. Therefore, the City Manager hereby authorizes the use of the City’s baseball fields, located at the South end of Cornell Avenue, as a suitable venue for a community display of fireworks, subject to the following restrictions and conditions. A more specific area within the boundaries of the baseball fields will be designated immediately prior to the special event by the Fritch Fire Department and the Fritch Police Department. The City Manager authorizes this special event to take place on July 4, 2026. Fireworks may be possessed, used, and discharged, as prescribed above, during the hours of 8:00pm and midnight on this date, as follows: RESTRICTIONS AND CONDITIONS •	All fireworks that are possessed, used, and discharged shall be done so in a safe manner that does not conflict with existing State laws and other City Ordinances. •	By participating in this community-wide, special event, participants agree to indemnify and hold harmless the City of Fritch, its officers, agents, and employees from all suits, actions, claims, damages, personal injuries, whatsoever, including attorney’s fees, brought for or on account of any negligent act or omission of a participant. •	This special event is automatically canceled if the Hutchinson County Commissioner’s Court enacts a burn ban that includes the corporate City limits or its extraterritorial jurisdiction. •	No person shall engage in loud, rude, crude, lewd, disorderly, or abusive conduct. •	The Fritch Police Department and the Fritch Fire Department are designees of the City Manager with the authority to discontinue any activity they reasonably deem to be of a dangerous, hazardous, or otherwise unsafe character, including terminating the entire event or removing individuals from the grounds. •	All participants are responsible for leaving the baseball fields clear of all debris, trash, and other refuse. •	Non-compliance with these restrictions, disorderly conduct, or other violations of law by any number of participants may be taken into consideration when determining any future fireworks authorization by the City Manager.
